A Virginia Circuit Court voided the entire Prince William Digital Gateway rezoning because the §15.2-2204 public-hearing notice ran only three days before the hearing, and key rezoning materials were not available at the time of the first notice.

Outcome

Rezoning void ab initio. Upheld by the Virginia Court of Appeals. Voter support for new Virginia data centers subsequently collapsed from 69% to 35%.

What the record shows

Project Sail passed on a split 3-2 vote with the county's own staff report declaring the application inconsistent with the comprehensive plan, on a brand-new data-center ordinance with 17 conditions attached at the dais.

Outcome

Approved but primed for appeal. Opposition has archived the full record. Every one of the 17 conditions is now litigation ammunition.

What the record shows

ERCOT's large-load queue is being rebuilt under PGRR145 and NPRR1234 with binding completeness gates. Projects without sufficient submission data are formally tracked in a "No Studies Submitted" category with queue-position consequences, and SB6 curtailment duties attach to any ≥75 MW load interconnected after December 31, 2025.

Outcome

Not a denial. An indefinite deferral, which for a data center with a PPA timeline, a hyperscaler tenant, or a construction loan is functionally worse.

What the record shows

The Virginia Court of Appeals reversed Warrenton's attempt to withhold 3,100 emails about Amazon's Special Use Permit under the FOIA "working papers" exemption. The records-handling defect fed two years of litigation and political momentum that ended in the Town Council repealing data center zoning entirely.

Outcome

The records lost the FOIA case, became the evidence base for the repeal movement, and contributed to Warrenton removing data centers from its industrial zoning altogether in July 2025.

What the record shows

Loudoun County eliminated by-right data center development county-wide. The grandfathering clause protects only applications under review as of February 12, 2025, with no substantial changes. Every mid-flight amendment is now a potential loss of vested rights.

Outcome

Every legacy packet needs a vesting analysis. Routine amendments that once sailed through can now trigger a requirement to refile under the new SPEX regime.
