The context

Georgia Power, Southern Company territory

Georgia's data center sales tax exemption passed in 2022 (HB 1291) and has been a central subsidy for the Atlanta-Metro cluster. The Georgia PSC unanimously approved a 9,885 MW generation expansion in December 2025, anchored in data center demand — combined with a required cost allocation pass-through in the next base case. The General Assembly passed an incentive pause in 2024 that Governor Kemp vetoed; the political debate remains active.

Georgia Data Center Sales and Use Tax Exemption

Sales/use tax exemption

Threshold: $15M capex (min), high-technology DC designation
Benefit: Full state + local sales tax exemption on qualifying DC equipment and infrastructure
Clawback exposure: Yes — failure to maintain operations or thresholds can revoke certification
Cliffcenter notes: Lower minimum investment than Virginia and Texas, which has attracted smaller operators. Political pressure on the program is real but so far hasn't tightened eligibility.

Quality Jobs Tax Credit

Job creation tax credit

Threshold: 50 new jobs paying 110% of county average wage
Benefit: $2,500–$5,000 per job per year for 5 years, non-refundable income tax credit
Clawback exposure: Partial — jobs must be maintained
Cliffcenter notes: Stacks with the sales tax exemption for operators with local employment. Most hyperscaler DC projects clear it easily.

Freeport tax exemption

Local property tax exemption

Threshold: Local county adoption, inventory qualifying as Class 1–4
Benefit: Up to 100% exemption of local property tax on qualifying inventory
Clawback exposure: Per county
Cliffcenter notes: Particularly useful for operators with significant hardware inventory. County adoption matters — not every jurisdiction has opted in.

Georgia QuickStart workforce grant

Workforce training grant

Threshold: Commitment to hire Georgia residents
Benefit: State-funded training program customization at no cost to the employer
Clawback exposure: No direct clawback
Cliffcenter notes: Administered through the Technical College System of Georgia. Useful negotiation lever with local economic development authorities.

Base case cost shift

The 2027 base case will reflect the Georgia Power expansion costs. Existing incentive awards do not shield customers from the cost shift — expect a material bill increase on new deals.
