Statewide moratoriums were unthinkable 18 months ago. In April 2026 we have the first (Maine) with more in the pipeline. This table is updated as bills advance.

Group patterns
The specific groups change by jurisdiction, but the patterns are remarkably consistent. Each category of opposition responds to a different kind of engagement — and misreading the category is the most common failure mode.
Most active in the Southwest (Arizona, Nevada, Utah) and in drought-sensitive areas of Texas, Washington, and California. Focus on cooling water use and discharge. Typically aligned with environmental justice groups and local water utilities.

Most active in states where the PJM or ERCOT capacity markets have priced high recently. Focus on rate impacts to residential customers from new large loads. Aligned with consumer advocates and ratepayer groups.

Engagement playbook
The sequence matters more than the individual steps. Engaging on step 5 before step 1 is how most projects lose their community. Running all five in parallel is how most projects earn it.
The cheapest time to engage is before the opposition organizes. Our playbook starts 180 days before any public announcement, with outreach to local officials, faith leaders, and likely opposition groups. Most of the engagements that go well look like this; most that go badly skipped this step.
Community engagement that starts with 'here is our project and here is our community benefit' typically fails. Engagement that starts with 'what does your community need' and then proposes a project that addresses some of those needs typically succeeds.
Data center proponents typically bring renderings and job counts. Communities respond better to water balance models, noise studies, traffic analyses, tax revenue projections, and community benefit commitments in writing. Our services team delivers all of these as structured artifacts.
Statewide moratorium legislation typically emerges from grassroots pressure, not from elected officials acting alone. Engaging the grassroots groups early can shift or stop the legislation before it gets filed.
